Terms of Service

1. Agreement to these terms

These Terms of Service ("Terms") govern access to and use of the MealCare platform, MealCare Display, and this website (together, the "Service"), operated by MealCare ("we", "us"). By creating an account, starting a trial, or using the Service, you agree to these Terms on behalf of yourself and, where applicable, the organization you represent. If you do not agree, do not use the Service.

2. The Service

MealCare is a business-to-business food safety assurance platform covering supplier assurance, production control, HACCP monitoring, traceability, audit readiness, and related workflows. MealCare Display extends the platform with guest-facing dining screens that present dish, allergen, and nutrition information from your records. The Service supports — but does not replace — your own food safety obligations: you remain responsible for your compliance with applicable food safety laws and the requirements of your regulators.

3. Accounts and responsibilities

You are responsible for the accuracy of information entered into the Service, for maintaining the confidentiality of account credentials, and for the actions of users under your account. You must ensure that your use of the Service, including information shown to guests through Display, is accurate and lawful in your jurisdiction.

4. Trials, plans, and billing

New customers may start a 14-day free trial with full Professional features; no payment method is collected and nothing is charged automatically when the trial ends. Paid subscriptions are billed per site per month (or annually, where selected) according to the plan and prices presented at the time of purchase. Display add-on screens are billed per display per month. Prices are stated in USD unless otherwise agreed; local billing options may be available.

Plan changes take effect from the next billing cycle unless otherwise agreed. Enterprise agreements may be governed by a separate order form, which prevails over these Terms where they conflict.

5. Customer data and ownership

Your operational records — inspections, temperature logs, corrective actions, documents, dish and menu data, and similar content — remain yours. We process them only to provide the Service, as described in our Privacy Policy. You are responsible for having the right to store and process the data you enter.

6. Acceptable use

You may not misuse the Service — including attempting unauthorized access, interfering with its operation, using it to store or distribute unlawful content, reselling it without an agreement, or using it to mislead consumers or regulators.

7. Display devices

MealCare Display runs on Android tablets or smartphones that you provide and own. You are responsible for the physical devices, their network connectivity, and their placement. Pairing a device connects it to your account; you should unpair devices you no longer control. We may collect limited device status information (such as pairing identifiers and heartbeat signals) to operate the feature, as described in the Privacy Policy.

8. Availability and support

We work to keep the Service available and dependable, but it is provided "as is" and "as available" without uptime guarantees unless a service level agreement is included in an Enterprise contract. Support channels depend on your plan.

9. Intellectual property

The Service, including its software, design, and content (excluding your data), is owned by MealCare or its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service for your internal business purposes during your subscription.

10. Limitation of liability

To the maximum extent permitted by law, MealCare is not liable for indirect, incidental, special, or consequential damages, or for loss of profits, revenue, or data. Our total liability arising out of the Service in any 12-month period is limited to the amounts you paid for the Service in that period. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

11. Suspension and termination

You may cancel your subscription at any time, effective at the end of the current billing period. We may suspend or terminate access for material breach of these Terms after reasonable notice where practicable. Upon termination we will make your data available for export for a reasonable period before deletion.

12. Changes to these terms

We may update these Terms from time to time. Material changes will be communicated through the Service or by email, and the "last updated" date above will change. Continued use after changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the jurisdiction specified in your order form or, absent one, the jurisdiction in which the MealCare contracting entity is established, without regard to conflict-of-law rules.
